Add-and-Save/Upgrade-and-Save Terms and Conditions
1. This Add-and-Save and Upgrade-and-Save offer is available between November 1 2004 and Oct 31 2005. In order for the Customer to take up the Add-and-Save and Upgrade- and-Save offer, the Customer’s signed support quotation acceptance form must be received by HP by Oct 31 2005.
2. This Add-and-Save offer is available for genuine HP branded products only and is intended for selected customers with an existing HP Support Services contract. HP may at its sole discretion extend the Add-and-Save offer to non-HP branded products on a case by case basis, but is under no obligation to do so.
3. Pricing for both the Add-and-Save and Upgrade-and-Save offers is based on standard HP list price. Any other purchase arrangements between HP and Customer will not apply to Support taken up under these offers.
4. The Add-and-Save offer and Upgrade-and-Save offer is not available in conjunction with any other offer or discount. Accordingly, if Customer accepts either of these offers, no other pricing or discounts will apply with respect to the support taken up under these offers.
5. The Add-and-Save offer is only available for products that are not presently covered by any HP support contract (including HP CAREPAK or HP SupportPack), and have not been covered by any such HP support contract at any time during the 6 months prior to the commencement of this offer.
6. The Add-and-Save offer is not available for purchase with new product sales. For a product to be eligible for Support under this Add-and-Save offer, Customer must have owned the product for a minimum of 3 months prior to the commencement of this offer.
7. The Add-and-Save offer is available only with respect to products that are eligible for Support under HP’s current support offering and relevant Support terms and conditions. For example, the product must be at current specified revision levels and, in HP’s reasonable opinion, be in good operating condition. In the case of an HP software product, the software must be either the current and immediately preceding version of that software, and used with hardware that is included in HP-specified configurations. The availability of this offer for products not within HP’s current Support offering will be at HP’s sole discretion.
8. Standard HP Support Terms and Conditions, Exhibit ss/5 and the applicable data sheets will govern the Support of the nominated product. These will either be included with relevant customer support quotation acceptance form or are available upon request. By submitting a support quotation acceptance form in accordance with either the Add-and-Save or Upgrade- and-Save offers, Customer agrees to be bound by the terms and conditions of these offers and the additional terms, exhibits and data sheets referred to above.
9. In the event that a support service taken up under the Add-and-Save offer is cancelled, Customer will receive a pro-rata refund for the unused services, less any applicable early termination fees. Any such refund will not take into account the additional 12 months of service in the Add-and-Save offer. This term takes precedence over any conflicting term set out in the documents referred to in clause 8 above.
